Scope

These terms govern all bookings made through 4Drive Spain at 4drivespain.com. By completing a booking, you accept these conditions in full. The service provided by 4Drive Spain is the facilitation of vehicle reservations with local rental companies operating across Spain. Each vehicle is owned and operated by an independent rental company, and that company issues the actual rental agreement at the time of collection.

Your contract for the rental itself is directly with the local provider, not with 4Drive Spain. We supply a booking voucher that confirms your reservation and specifies pickup arrangements, vehicle details, payment requirements, and contact information for the rental company. The terms in your voucher form part of these conditions.

Bookings and the Rental Agreement

When you complete a booking on our platform, you receive a confirmation email and voucher. That voucher is your proof of reservation. The rental agreement itself is signed at the pickup location, where the rental company records vehicle condition, fuel level, and any pre-existing damage in the contract document. Both parties sign to confirm the state of the vehicle at handover.

Collection takes place at the location and time you selected during booking. Depending on the rental company, pickup may occur at an airport desk, at a terminal meeting point, or by delivery to your accommodation. The voucher states the exact procedure and includes the company's direct contact details. You must present the voucher, your driving licence, and the payment card specified in the voucher at the time of collection.

If the vehicle you reserved becomes unavailable due to circumstances beyond our control, the rental company will provide a substitute of equal or higher specification at no extra cost. If no substitute meets your needs, you may cancel for a full refund of any advance paid.

Advance Payment and Balance

At the time of booking, you pay an advance online by debit or credit card through our secure payment gateway. We do not accept cash payments online. The advance secures your reservation and is non-refundable except as outlined in the cancellation section below.

The balance of the rental amount is due when you collect the vehicle. The method of balance payment depends on the specific vehicle you have booked, not on vehicle class or category. Accepted methods may include debit card, credit card, or cash. Your voucher specifies which methods the rental company will accept for that particular vehicle.

If you do not hold a credit card and the voucher indicates that the rental company accepts debit cards, we recommend ensuring your card has a sufficient available limit to cover both the balance payment and any deposit hold that may be applied.

Deposit Conditions

Most rental companies apply a deposit hold on a payment card at the time of collection. This hold is a temporary block of funds as security against damage, traffic fines, fuel shortages, or late return. The deposit amount and the type of card required vary by vehicle and are stated in your voucher.

The deposit is independent of any damage waiver or insurance coverage you may purchase. Even when a damage waiver is in place, the rental company typically retains a deposit hold and an excess applies to claims. The deposit is released after the vehicle is returned and inspected, usually within seven to fourteen days, depending on your card issuer.

If the rental company accepts debit cards for the deposit, ensure your card limit can accommodate the hold. If a credit card is required and you do not have one, you will not be able to collect the vehicle, and standard cancellation terms apply.

Drivers and Documents

The person named as the main driver on the booking must be present at collection and must hold a valid full driving licence. EU-issued licences are accepted throughout Spain. Drivers holding licences issued outside the EU should carry an International Driving Permit alongside their national licence.

Additional drivers may be added at the rental desk for a fee. Each additional driver must present a valid licence and must be listed on the rental agreement. Only persons named in the rental agreement are permitted to drive the vehicle. Allowing an unauthorised person to drive voids all coverage and makes you liable for any damage or fines incurred.

Minimum and maximum age limits are set by the rental company and vary by vehicle type. Some vehicles require the driver to have held a licence for a minimum period. These requirements are shown during the booking process and in your voucher.

Use of the Vehicle

You may drive the vehicle on public roads and on maintained gravel roads where the surface is suitable for the vehicle type. Driving on unmade tracks, beaches, river beds, or off-road terrain is prohibited unless you have hired a four-wheel-drive vehicle and the rental agreement expressly permits such use.

Spain operates right-hand traffic. Speed limits are 50 km/h in urban areas, 90-100 km/h on rural roads, and 120 km/h on motorways. Toll roads, known as autopistas and marked with an AP prefix, are common in Catalonia and near Madrid. Free motorways, called autovias with an A prefix, cover most other regions. Optional toll transponders for Catalonia autopistas can be arranged at the rental desk for a fee.

Driving into Portugal and France is generally permitted without additional paperwork. If you plan to take a ferry to Morocco, you must obtain written approval from the rental company before travel. Ferry approval for Morocco crossings must be arranged in advance and is subject to an additional fee.

Smoking is not allowed inside the vehicle. Pets may be transported only with prior written approval from the rental company. Failing to comply with these rules may result in cleaning fees or other charges deducted from your deposit.

Changes and Cancellation

You may request changes to your booking by contacting us at [email protected]. Changes to dates, pickup location, or vehicle type are subject to availability and may incur an amendment fee. If the new arrangement costs more than the original booking, you must pay the difference before the change is confirmed.

Cancellations made more than seven days before the scheduled pickup date receive a refund of the advance minus an administration fee. Cancellations made within seven days of pickup, or failure to collect the vehicle without prior notice, result in forfeiture of the full advance. No refund is given for early return of the vehicle or for unused rental days.

We reserve the right to cancel your booking if payment fails, if you provide false information, or if circumstances beyond our control make it impossible to honour the reservation. In such cases, we refund any advance paid in full.

Liability

4Drive Spain acts as a booking booking service and is not liable for the condition of the vehicle, the conduct of the rental company, or events that occur during the rental period. Your contractual relationship for the rental is with the local company that supplies the vehicle.

You are responsible for all damage to the vehicle, theft, loss of keys, fuel discrepancies, traffic fines, and parking charges incurred during the rental. Damage and theft liability is limited by any damage waiver or insurance you purchase, subject to the excess stated in that coverage.

You indemnify 4Drive Spain and the rental company against any claims, costs, or losses arising from your use of the vehicle, including but not limited to accidents, traffic violations, illegal activity, or breach of the rental agreement.

Complaints

If you experience a problem during your rental, contact the rental company immediately using the details provided in your voucher. Most issues can be resolved on the spot or by telephone with the company's local office.

If you remain dissatisfied after speaking with the rental company, you may submit a formal complaint to 4Drive Spain by email at [email protected]. Include your booking reference, a description of the issue, and copies of any relevant documents or photographs. We will investigate and respond within ten working days.

Governing Law

These terms and conditions are governed by the laws of Spain. Any dispute arising from or related to a booking made through 4Drive Spain shall be subject to the exclusive jurisdiction of the courts of Spain.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision does not constitute a waiver of that right.

These terms were last updated in September 2026. We may revise them from time to time. The version in force at the date of your booking applies to that reservation.
